2. Eligibility
You represent that you are at least eighteen (18) years of age and have legal capacity to enter contracts. Where local law imposes higher age thresholds for accommodations or gaming access, you must satisfy those requirements. Casino and gaming amenities, where offered, are restricted to verified guests meeting jurisdictional rules communicated at check-in.
3. Website use license

4. Reservations, rates, and payment

Confirmed reservations require valid payment instrument and acceptance of rate rules disclosed at purchase. Taxes, resort fees, and local levies may apply. Currency conversion is handled by your card issuer if applicable. Chargebacks initiated without good-faith dispute resolution may result in blacklisting and recovery of costs.
5. Cancellation, changes, and no-shows
Cancellation windows, penalties, and prepayment rules vary by rate plan, season, and channel. The policy attached to your confirmation email controls. No-shows and late cancellations may incur fees up to the full stay. Early departures are generally non-refundable unless mandated by law or Executive override.
6. Guest conduct

We do not warrant uninterrupted or error-free access. Mountain destinations may experience weather delays; travel insurance is recommended.
10. Limitation of liability
To the maximum extent permitted by applicable law, AGAR and its affiliates, directors, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill arising from your use of the site or stay, except where liability cannot be excluded by law. Aggregate liability for direct damages relating to the website shall not exceed the greater of (i) one hundred (100) CHF or (ii) the amounts you paid to AGAR specifically for digital services in the twelve (12) months preceding the claim. Different caps may apply to physical hospitality services under mandatory national rules.
11. Indemnity
You agree to defend and indemnify AGAR against third-party claims arising from your breach of these terms, misuse of the site, unlawful conduct on property, or infringement of others’ rights, except to the extent caused by AGAR’s willful misconduct.
12. Force majeure
AGAR is not liable for delays or failures due to events beyond reasonable control, including natural disasters, pandemics, labor disputes, utility outages, government orders, or supply chain failures. We will use commercially reasonable efforts to offer rescheduling or credits where feasible.
13. Privacy and communications
Personal data practices are described in our Privacy Policy. By providing contact details, you consent to transactional messages. Marketing emails include opt-out mechanisms compliant with applicable law.
14. Third-party links and services
agarhotel.com may reference transportation vendors, booking partners, or social platforms. Their terms and privacy statements govern your use. AGAR is not responsible for third-party content or actions.
15. Modifications

16. Governing law and disputes
Unless mandatory consumer protections specify otherwise, these terms are governed by the laws of Switzerland, without regard to conflict-of-law rules. Courts in the canton of our registered seat have exclusive jurisdiction for business disputes; consumers may have non-waivable rights to sue in their home jurisdiction.
17. Severability
If any provision is held invalid, the remainder stays enforceable to the fullest extent.
